Frank Mazzei was postponed today because the federal judge handling the case was recovering from surgery. A spokeswoman for U.S. District Court Judge Rabe Marsh said it had been thought that the judge would be able to return to work today, but he had not received his doctor's approval to return. The spokeswoman said sentencing would be take place in the near future, possibly next week. Mazzei, convicted last November on federal extortion charges, faces a maximum of 20 years in prison.

The veteran Democrat was found guilty of using his position to extort $20,000 in alleged kickbacks from the BMI which leased office space to two state agencies in Mazzei's home district on Pittsburgh's South Side. Mazzei, 62, could also receive a $10,000 fine on each of two counts, and Judge Marsh could prohibit him from exercising his Senate office. He has retained his seat pending sentencing. Despite some objections from the public and Allegheny County Dist. Atty.

John J. Hickton, the Senate has ignored Mazzei's conviction. His colleagues suggest that no action on his ouster can be taken until he is sentenced and perhaps not until the conviction is upheld. Post-trial motions have delayed the sentencing until now. Mazzei's attorney, H.

David Rothman, has also said he will appeal the conviction, a process that could take well over a year.
